1. Agreement to Terms

These Terms and Conditions ("Terms") govern your access to and use of the DashDrives website, mobile application, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility

To use the DashDrives Service, you must be at least 18 years old and possess a valid driver's license. Additional eligibility requirements may apply depending on the vehicle you wish to rent and local regulations.

Vehicle owners must be at least 21 years old, have a valid driver's license, and legally own or have authorization to list the vehicle on our platform.

3. Account Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Platform Use

4.1 General Rules

You agree not to:

• Use the Service for any illegal purpose or in violation of any local, state, national, or international law
• Violate or encourage others to violate the rights of third parties, including intellectual property rights
• Post, upload, or distribute any content that is unlawful, defamatory, libelous, inaccurate, or that a reasonable person could deem to be objectionable, profane, indecent, pornographic, harassing, threatening, hateful, or otherwise inappropriate
• Interfere with security features of the Service
• Use the Service to transmit harmful code or interfere with or disrupt the Service or servers connected to the Service
• Attempt to bypass any measures we may use to prevent or restrict access to the Service
• Impersonate or misrepresent your affiliation with any person or entity

4.2 Content

You retain ownership of any content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, modify, create derivative works based on, distribute, publicly display, and publicly perform your content in connection with operating and providing the Service.

5. Vehicle Rentals

5.1 For Renters

When renting a vehicle through DashDrives, you agree to:

• Provide accurate information about yourself and your driving history
• Use the vehicle only for lawful purposes and in accordance with the rental agreement
• Return the vehicle in the same condition as when received, except for normal wear and tear
• Comply with all traffic laws and regulations during the rental period
• Not sublet or allow unauthorized drivers to operate the vehicle
• Not use the vehicle for commercial purposes unless specifically authorized
• Pay for any traffic violations, tolls, or parking fees incurred during the rental period

5.2 For Vehicle Owners

When listing a vehicle on DashDrives, you agree to:

• Provide accurate information about your vehicle
• Ensure your vehicle is legally registered, insured, and in safe operating condition
• Make the vehicle available as agreed upon in the rental agreement
• Maintain your vehicle in accordance with manufacturer recommendations
• Disclose any known issues or defects with the vehicle
• Comply with all applicable laws and regulations regarding vehicle rentals

6. Payments and Fees

6.1 Rental Fees

Rental fees are set by vehicle owners and displayed on the vehicle listing. The total rental cost will include the base rental fee, DashDrives service fee, insurance, and any applicable taxes.

6.2 Payment Processing

All payments are processed through our secure payment system. By using the Service, you authorize us to charge your payment method for all applicable fees.

6.3 Cancellations and Refunds

Cancellation policies vary depending on the vehicle listing and timing of cancellation. Please refer to our Refund Policy for detailed information.

7. Insurance

All rentals through DashDrives include insurance coverage. The specific terms, conditions, and coverage limits are provided during the booking process. Both vehicle owners and renters must comply with all requirements and procedures related to insurance claims.

8. Limitation of Liability

To the maximum extent permitted by law, DashDrives and its officers, employees, directors, shareholders, parents, subsidiaries, affiliates, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

In no event shall our total liability to you for all claims exceed the amount you have paid to DashDrives in the past six months.

9. Dispute Resolution

You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be settled by binding arbitration, except that each party retains the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
